Spotgram - Terms of Service

Application

These Terms set out the conditions for using the Spotgram app (the "Service") provided by us.
Users shall use the Service only after agreeing to these Terms.

The following terms have the meanings set out below.

"User" means any person who uses the Service.
"User Content" means photos, text, reviews, ratings, comments, spot information including location information, and any other information submitted, transmitted, or registered by a User through the Service.
"Content" collectively means User Content and information provided by us or third parties.

Registration using a method specified by us may be required to use the Service.
Users shall keep their registration information truthful and accurate and promptly update it when it changes.
Unless caused by our willful misconduct or gross negligence, we are not responsible for damage arising from use of a User's account.

The Service enables Users to browse, register, and share locations and related information associated with anime and other works, including pilgrimage locations.
Titles, images, external links, and other third-party content shown through the Service belong to their respective rights holders. We do not guarantee affiliation with or endorsement by such rights holders.
Use of the Service may involve travel or tourism. Users are responsible for their own safety and for complying with laws and rules at each location or facility.

Users must not engage in any of the following when using the Service:

Conduct that violates laws or public order and morals.
Infringement of copyrights, trademarks, portrait rights, privacy, or other rights of any third party.
Content involving defamation, discrimination, threats, harassment, stalking, bullying, excessively sexual or violent expression, or content inappropriate for minors.
Posting personal information that could identify a person, unless the person has expressly consented.
Content that encourages nuisance conduct toward facilities, communities, works, or individuals.
Providing benefits to antisocial forces or equivalent conduct.
Unauthorized use of the Service, including unauthorized access, scraping, reverse engineering, excessive loads, or exploiting bugs.
Impersonation, false information, mass duplicate postings, or other interference with operations.
Unauthorized interference with servers, networks, or systems belonging to us or third parties.
Any other conduct we deem inappropriate.

Rights in User Content generally remain with the User who posted it. Where User Content includes third-party material, the User is responsible for obtaining necessary rights.
Users grant us a non-exclusive, royalty-free right to use User Content for provision, operation, improvement, fraud prevention, and promotion of the Service, including reproduction, public transmission, display, adaptation, editing, excerpts, and thumbnail creation.
We do not guarantee backups of User Content. Users should maintain their own backups as needed.

Users may report inappropriate User Content or Users through the methods we provide.
Users may block specific Users through the methods we provide. As a rule, content from blocked Users will not be displayed on the blocking User's screen.
If we determine that User Content violates or may violate these Terms, we may without prior notice hide or remove all or part of it, suspend or delete accounts, or take other necessary measures.
This section also aims to meet Apple's guidelines for user-generated content, including prevention of objectionable content, response to reports, blocking, and publication of contact information. Apple Developer

We may change, suspend, or terminate the Service at our discretion.
Unless caused by our willful misconduct or gross negligence, we are not liable for damage arising from any such change, suspension, or termination.

We do not warrant completeness, accuracy, continuity, fitness for a particular purpose, or non-infringement of third-party rights in connection with the Service.
Unless caused by our willful misconduct or gross negligence, we are not responsible for disputes between Users or between a User and a third party.
Where we are liable, our liability is limited to direct and ordinary damages, excluding lost profits and indirect damages.

We handle User information in accordance with the separately established Spotgram Privacy Policy.

We may amend these Terms as necessary.
For material changes, we will provide notice in the app or by another method we deem appropriate.
Use of the Service after changes take effect constitutes agreement to the amended Terms.

These Terms are governed by the laws of Japan.
The Tokyo District Court shall have exclusive agreed jurisdiction as the court of first instance for disputes concerning the Service.
